What is NHR?
The Non-Habitual Resident regime is a special tax status available to individuals who become Portuguese tax residents and have not been tax resident in Portugal in the previous 5 years.
Under NHR, qualifying individuals benefit from a 10-year period of reduced or zero Portuguese taxation on most foreign-source income.
What NHR Covers
For the first 10 years of Portuguese tax residency, NHR holders may benefit from:
- Foreign pension income: Often taxed at 10% flat rate in Portugal (versus standard rates up to 48%)
- Foreign rental income, dividends, and interest: Often exempt if taxable in the source country under a double tax treaty
- Foreign employment income: May be exempt if taxed at source
- Capital gains on foreign assets: May be exempt
Note: NHR was reformed in 2024. The current version (IFICI — Incentivo Fiscal à Investigação Científica e Inovação) is targeted at certain professions and activities. The “classic” NHR still applies to those who registered before the 2024 deadline. For investors considering Portugal now, specialist tax advice is essential.
NHR and the Golden Visa
Getting a Golden Visa does not automatically make you a Portuguese tax resident. You only become a tax resident if you spend 183+ days per year in Portugal, or establish your habitual residence there.
Many Golden Visa holders never become Portuguese tax residents — they simply hold residency cards while living elsewhere. For those who do wish to become tax resident and benefit from NHR (or its successor regime), the combination is extremely powerful.
Practical Example
An investor from the US or UK who moves their tax residency to Portugal under NHR could benefit from:
- 10% flat rate on pension income
- Possible exemption on foreign dividends and rental income
- Reduced overall tax burden for a decade
